The following terms of service and end user license agreement (“EULA”) constitute an agreement between you and HWDOT. This EULA governs your use of Software and Services (as specified below).
For purposes of this EULA "Software" means all software programs distributed, published or otherwise made available by HWDOT or its affiliates including, but not limited to mobile games, downloadable/installable games for personal computer, and games accessed by means of a browser or other online communication method. Software also includes updates and upgrades as well as accompanying manual(s), packaging and other written, files, electronic or on-line materials or documentation, and any and all copies of such software and its materials.
“Services” means all services made available by HWDOT, including but not limited to services accessed through mobile games, by means of a browser or by other online communication method.
Software and Services are collectively referred to as “HWDOT Services”.
THE SOFTWARE IS LICENSED, NOT SOLD. YOUR USE OF THE SOFTWARE (AS SPECIFIED BELOW) IS SUBJECT TO THE TERMS AND CONDITIONS SET FORTH IN THIS EULA. BY INSTALLING, USING OR ACCESSING THE HWDOT SERVICES OR ANY MATERIALS INCLUDED IN OR WITH THE HWDOT SERVICES, YOU HEREBY ACCEPT THE TERMS OF THIS EULA.
If you do not accept the terms of this EULA, do not install, use or access the HWDOT Services.
1. Software License
HWDOT gives you the personal, non-exclusive, non-sublicensable and limited right (known legally as a ‘licence’) to use it to download or install the HWDOT Software on your devices (computer,laptop,mobile devices,etc) for your personal use. This is licensed (not sold) to you for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by HWDOT, in the manner permitted by this EULA. We may revoke this license at any time.
At all times we continue to own all of HWDOT Software, its installer, any updates or additional content for them, manuals or other materials about them and the intellectual property rights in them, including all copyright, trademarks, patents and legal things like that. All rights reserved.
2. What you can't do with the Software
Please act reasonably and don't do any of the following:
a. copy, rent, lend, lease, sublicense, distribute, sell, publicly display, create derivative works from the Software or give your copy of it to someone else
b. Hack, reverse engineer, decompile, disassemble, circumvent or modify the Software or any part of it (including any security or protection software)
c. do anything with the Software for commercial use (e.g. for money)
d. create, distribute or use any cheats or exploits on the software
e. do or say anything harmful or offensive regarding the software
f. remove any proprietary labels, tags or content from the software
g. do anything we might consider inappropriate or illegal with or regarding the software
3. Third party services
HWDOT Services may include links to third party services and/or the third party services may be made available to you via HWDOT Services. These services may include, but are not limited to gameplay recording and sharing, social medial connectivity and the like. These services are subject to respective third party terms and conditions. Please study these third party terms and conditions carefully as they constitute an agreement between you and the applicable third party service provider.
4. Information collection and use; Privacy policy
By installing, accessing or using the HWDOT Services, you consent to these information collection and usage terms, including (where applicable) the transfer of data into a country outside of the European Union and/or the European Economic Area or the United States of America.
HWDOT respects your privacy rights and recognizes the importance of protecting any information collected about you. HWDOT's privacy policy as amended from time to time is available at https://www.hwdot.com/p/privacy.html ("Privacy Policy") and applicable to this EULA. HWDOT’s Privacy Policy defines how, why and to which extent HWDOT collects and uses personal and non-personal information in relation to HWDOT's products and services. By installing, accessing or using the HWDOT Services you explicitly agree with the terms and conditions of HWDOT’s Privacy Policy and to any terms and conditions included therein by reference.
